Billings corp. sues Shields store

Wilsall General Store is facing a lawsuit after a Billings corporation claimed the grocery store refused to pay for over $19,000 in deliveries made last year. 

Valley Distributing Inc. says it discovered $19,371 in unpaid invoices sent to the Wilsall grocery store by Service Candy Company, which made deliveries to the store, according to a complaint filed with Park County’s Montana Sixth Judicial District Court.

Valley Distributing bought Service Candy Company in December 2015 and after the purchase discovered the unpaid invoices, the complaint states.

Service Candy Company and Wilsall General Store entered into a verbal contract April 2015 agreeing the Wilsall store would pay for food and tobacco products within 15 days of a delivery, according to the complaint. 

The unpaid-for deliveries were made between May and August of 2015, the document states. 

Valley Distributing claims the grocery store has continuously refused to pay for the 2015 deliveries despite a demand made by the corporation July 12.

Valley Distributing is asking for the full $19,371 in damages, as well as 18 percent in interest until the alleged debt is paid. 

A Wilsall General Store manager declined to comment Tuesday.
