A Livingston man will not be retried on a charge of attempted deliberate homicide, the Montana Supreme Court has ruled.
The local Sixth Judicial District Court had dismissed the case against Daniel J. Colvin, 29, in June of last year, stating his rights to due process had been violated when his defense team was unable to examine a key piece of evidence. The evidence was a Jeep owned by shooting victim Michael Aja, who had been shot by a .38-caliber pistol while in the vehicle, according to court documents.
